Cheeba Cheeba CBD – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cheeba Cheeba CBD website, mobile applications, in-store services and any related features (collectively, the “Service”). Please read them carefully. By accessing or using our Service, or by purchasing any product from us, you (“you,” “your,” or “Customer”) agree to be bound by these Terms. If you do not agree, you must immediately cease all use of the Service.

1. Definitions

1.1 “Cheeba Cheeba CBD,” “we,” “us” or “our” refers to Cheeba Cheeba CBD, a company registered in England & Wales (Company No. 12706136), with its principal place of business at 111 Chesterfield Road, Sheffield, S8 0RN.
1.2 “Service” means our website, mobile applications, in-store offerings, products, content, and any other features provided by Cheeba Cheeba CBD.
1.3 “Products” means all goods sold under the Cheeba Cheeba CBD brand, including but not limited to CBD oils, edibles, vapes, topicals, capsules, mushroom supplements, apparel and café items.
1.4 “User Content” means any information, data, text, graphics, photographs, reviews, comments or other materials that you upload, post or otherwise transmit through the Service.

2. Eligibility & Account Registration

2.1 Age & Legal Capacity

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase CBD products.

  • By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract with us.

2.2 Account Information & Security

  • You agree to provide true, accurate, current and complete information when registering or ordering.

  • You are responsible for keeping your account password secure and confidential. All activity under your account is your responsibility.

  • Notify us immediately of any unauthorized use of your account.

3. User License & Restrictions

3.1 Limited License

  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

3.2 Restrictions

  • You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any portion of the Service without our prior written consent.

  • You may not use robots, spiders, data-mining tools or other automated means to access or scrape the Service.

  • You may not introduce viruses, malware or any code intended to disrupt the Service.

4. Product Descriptions & Pricing

4.1 Accuracy of Information

  • We endeavour to display accurate descriptions, images, pricing and availability of Products. However, errors may occur.

4.2 Price Changes & Typographical Errors

  • Prices are subject to change without notice.

  • In the event of a pricing error, we reserve the right to cancel or refuse orders placed at the incorrect price.

4.3 Limited Quantities & Availability

  • Some Products may be limited in quantity. We reserve the right to limit or cancel orders at any time.

5. Orders, Payment & Billing

5.1 Order Acceptance

  • Receipt of an order acknowledgment does not constitute acceptance. We reserve the right to accept or refuse any order.

5.2 Payment Methods

  • We accept major credit/debit cards and other payment methods as displayed at checkout.

  • All transactions are processed through a secure gateway; we do not store your payment card details.

5.3 Billing Errors

  • If you believe there has been a billing error, contact us at cheebacheeba@gmail.com within 30 days. We will promptly correct any confirmed errors.

6. Shipping, Delivery & Title

6.1 Shipping Options

  • Standard and expedited shipping are available. Estimated delivery times are provided but not guaranteed.

6.2 Risk of Loss

  • Title and risk of loss pass to you upon our delivery to the carrier.

6.3 International Orders

  • You are responsible for all duties, taxes and customs clearance fees on international shipments.

7. Returns, Exchanges & Refunds

7.1 Return Window

  • You may request a return within 30 days of receipt, subject to our Return & Refund Policy.

7.2 Unopened vs. Opened Products

  • Unopened Products may be returned for any reason.

  • Opened Products are only eligible if defective, damaged or shipped in error.

7.3 Process

  • Contact cheebacheeba@gmail.com to initiate a return. Follow our instructions to obtain a Return Merchandise Authorization (RMA).

7.4 Refund Timing

  • Upon inspection and approval, refunds to the original payment method will be issued within 5–10 business days.

8. User Content & Communications

8.1 Your Responsibility

  • You retain ownership of your User Content, but grant us a worldwide, royalty-free, irrevocable, sublicensable license to use, reproduce, modify and distribute it.

8.2 Prohibited Content

  • You agree not to post content that is unlawful, defamatory, obscene, pornographic, infringing or infringes any third-party rights.

8.3 Monitoring & Removal

  • We reserve the right (but have no obligation) to monitor, edit or remove any User Content at our sole discretion.

9. Privacy & Data Protection

Your privacy is important. Our Privacy Policy explains how we collect, use and safeguard your personal information. By using the Service, you consent to our collection and use of personal data as described therein.

10. Disclaimers & Warranties

10.1 “As Is” Service

  • THE SERVICE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 No Medical Advice

  • Information on our website is not intended as medical advice. Consult a qualified healthcare professional before using any CBD product.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHEEBA CHEEBA CBD OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend and hold harmless Cheeba Cheeba CBD, its officers, directors, employees and agents from any claim, demand or damage, including reasonable attorneys’ fees, arising out of (a) your breach of these Terms; (b) your violation of any law or third-party right; or (c) your use of the Service.

13. Force Majeure

Neither party shall be liable for delays or failures in performance due to causes beyond its reasonable control, including acts of God, war, terrorism, labour disputes, fire, flood, governmental action or Internet failures.

14. Termination

14.1 By You. You may terminate these Terms at any time by ceasing to use the Service.
14.2 By Us. We may suspend or terminate your access if you breach any provision, with or without notice. Sections 1, 3, 6.2, 8–16 shall survive termination.

15. Dispute Resolution & Governing Law

15.1 Governing Law. These Terms are governed by the laws of England and Wales.
15.2 Venue. Any dispute shall be brought exclusively in the courts of Sheffield, England.

16. Miscellaneous

16.1 Entire Agreement. These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement and supersede all prior understandings.
16.2 Severability. If any provision is held invalid, the remainder will continue in full force and effect.
16.3 Amendments. We may modify these Terms at any time by posting updated Terms on our site. Your continued use after changes are posted constitutes acceptance.
16.4 Notices. We may give notice by posting on our website or emailing the address you provide.
